Canada Nest Immigration Consulting Ltd. (“CanNest,” “we,” “us,” “our”) values the trust you place in us when you give us access to your Personal Data.
In particular, this Privacy Policy details how we collect, use and disclose personal and non-personal data you give to us when you access or use the online and/or mobile services, and websites, and software offered by CanNest. CanNest may also obtain limited Personal Data from third-party sources.

When you visit our Site or provide us with information, you agree to our use and disclosure of the information we collect, as described in this Privacy Policy, unless separate terms are offered by you in writing and accepted in writing by CanNest.
CanNest is the Controller in respect of all processing of Personal Data that we collect in accordance with this Privacy Policy unless otherwise provided in a separate written agreement. 1.1 Personal Data and Personal Information
For purposes of this Privacy Policy, Personal Data and Personal Information are used interchangeably to mean any information that relates to an identified or identifiable natural person. Non-personal data is any other information, such as aggregate, statistical data, we collect when you access or use our Site. Where this Privacy Policy refers to “data” or “information,” this may include both Personal Data and non-personal data.

2. Information We Collect
We collect information from and about you when you use our Site and register your profile through Job Matching Services.
2.1 Information You Provide to CanNest
We collect information, including Personal Data, from you when you register your profile, upload a resume or other content, or otherwise actively send us your data on or through our Site. This may include your first and last names, age, date of birth, sex, email address, contact number, address, employment information, and any other data included in a submitted profile or resume or that you choose to upload to our Site.
2.2 Information Collected When You Apply for Jobs
When you apply for a job on our website, CanNest may receive information about the status of your job application and the decisions taken by the Employer in disposing of your application, such as, for example, whether the application reached interview stage and whether a job offer was accepted or rejected. This information helps CanNest further understand the effectiveness of our Site and its features. CanNest uses this information for the purpose of improving the services we offer to Job Seekers and Employers.
2.2.1 What Personal Data is Required
Typically, we will prompt you at the point when you provide your Personal Data to us whether or not it is necessary that you provide this information in order for CanNest to provide particular services, products or features to you on our Site. If you choose not to provide your Personal Data in such instances when it is necessary, some or all of our services, products or features may not be available to you.
2.2.2 Storage of Your Personal Data
We retain our clients’ Personal Data to the extent it is adequate, relevant and limited to what is necessary for the purposes for which it is processed. In particular, we do not retain your Personal Data for any longer than necessary to perform the services, products and features outlined in this Privacy Policy that you request from us when you use or access our Site.

3. Limitation of Use or Disclosure of Personal Data
3.1 Where a Job Seeker Wants to Cancel a Job Application
To cancel a job application submitted through CanNest, you must contact CanNest directly.
3.2 Children’s Privacy
CanNest does not knowingly collect Personal Data from children under the age of nineteen (19), nor is this Site designed to collect information from or directed at children under the age of nineteen (19). If you are under the age of nineteen (19), you are not authorized to use this Site and should not send us any Personal Data through this Site or by other means.

4. Purposes, Uses, and Disclosures of Your Personal Data
We may process your Personal Data for any of the purposes set forth in sections 4 and 5 of this Privacy Policy, to the extent applicable, including to:
1. provide and tailor our Site, services, products and features to you,
2. connect you with our affiliates to help you find jobs,
3. measure and improve our Site, including the services, products and features we make available to you on our Site, and
4. protect our users and provide them with customer support.
More detail on these purposes, uses and disclosures of your Personal Data is set out below.
4.1 Your Contact Information
When you give CanNest contact information (such as your name and email address) and other forms of Personal and non-personal data, you agree that CanNest may utilize this information for the purposes outlined in sections 4 and 5, to the extent applicable. In particular, you agree that CanNest may, as part of providing its services to you, communicate with you, or initiate communication with you on behalf of a third party, through your CanNest account or through other means such as email, telephone (including mobile phone), or postal mail, including through the use of contact information that you may provide to CanNest or that CanNest may otherwise obtain from third-party resources.
4.2 Your Resume Information
Your resume information (such as your name, address, employment history, education history, qualifications, and other resume content you upload to our Site) becomes part of your CanNest profile when you upload it to our Site. At your direction, CanNest may also send your resume information to employers if you choose to apply for a job listing. Resumes uploaded to CanNest are set to private by default.
4.3 Sharing Your Information with Our Affiliated Employers
Our core mission, which we share with each of our affiliates, is to help job seekers find great jobs, and employers find great candidates. In order to support that mission we share certain information with our affiliates. Such information sharing is governed by this Privacy Policy.
Information shared by you with CanNest may be shared with any of our affiliated entities, no matter where located, to provide you with services, to improve the Site and optimize functionality on the Site, and other purposes as described in this Privacy Policy. In particular, such sharing strengthens CanNest’s ability to help people find jobs and employers find candidates. The services provided to you and the functionality of the Site could not be provided without such transfers. If you do not wish your information to be transferred in this way you should not use this Site.
4.4 Transfer of Information to Employers
CanNest sends Job Seeker Personal Data to Employers on the instruction of Job Seekers. Such transfers are performed in the course of the job search, application and interview process. Such Personal Data will be processed in accordance with the relevant Employer.

5. Additional Uses and Disclosures of Non-Personal Data
In addition to the other uses and disclosures of information set forth in this Privacy Policy, and notwithstanding anything in this Privacy Policy to the contrary, we may use and disclose, for any purpose, any non-personal data, except where we are required to do otherwise under applicable law. If we combine any non-personal data with Personal Data, then we will only use and disclose such combined information for the purposes described in section 4 of this Privacy Policy while it is so combined.

6. Security
CanNest seeks to use reasonable security measures to help protect against the loss, misuse and alteration of the Personal Data under CanNest’s control. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. In addition, please note that emails, messages sent via your web browser, and other similar means of communication with other users are not encrypted. Therefore, while we strive to protect your information, we cannot guarantee its security.
Please also be aware that we may use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that may be nonnegotiable; these service providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the misuse of any information, including Personal Data, by these companies.

7. Your Privacy Rights
As a CanNest user, you may avail yourself of the rights explained below. We may attempt to verify your identity through the email address or telephone number associated with your use of our Site prior to fulfilling any such request and reserve the right to deny a request where we are unable to satisfactorily complete this process. If you authorize someone to make a request on your behalf, we may also deny your request if we are unable to verify with you that the individual making the request is authorized to act on your behalf.
7.1 Your Right to Rectify Your Personal Data
CanNest users are able to edit and update most of their Personal Data held by CanNest by contacting us directly or accessing your profile. You may also make a formal request to edit or update your data by sending an email to info@cannestimm.com from the email address associated with your profile.

8. General Inquiries and Complaints
You may contact CanNest with any questions or concerns regarding this Privacy Policy by email at info@cannestimm.com. Please include your name and email address in any written request to us. Our privacy officer will manage your complaint in accordance with applicable law and will give you additional information about how it will be handled.
If you believe your data protection rights have been infringed by CanNest, you also have the right to complain to the appropriate regulatory authority responsible for data privacy where you are located.
